Legalising a UK Marriage Certificate: when you need an apostille and when you do not

A common question our team is asked is whether a UK marriage certificate needs to be apostilled for a spouse visa. The answer depends entirely on which country's authorities are asking for it - and the distinction is important before you start the process.

For UK Spouse Visa applications: no apostille required

If you are applying for a spouse visa to bring a partner to the UK, UK Visas and Immigration (UKVI) does not require the marriage certificate to be apostilled. The Home Office accepts the original civil marriage certificate as evidence of marriage. An apostille is not part of the UK visa application process.

For overseas visa and residency applications: apostille is usually required

If you are applying for a visa or residency permit in another country - moving abroad with your partner, for example - the overseas immigration authority will typically require your UK marriage certificate to be officially authenticated. In most cases this means obtaining an apostille from the FCDO. The GRO-issued marriage certificate can be submitted directly to the FCDO without solicitor certification and the apostille is attached to confirm the document's authenticity.

Religious marriage certificates are treated differently

If your marriage was registered through a religious ceremony and your certificate was issued by a religious body rather than the civil register, the document must be certified by a UK solicitor or Notary Public before the FCDO will accept it for apostille. 

When Embassy Attestation is also needed

For countries outside the Hague Apostille Convention - including the UAE and several Gulf states - the apostilled marriage certificate must also go through embassy attestation in London before it will be accepted. This is a separate step carried out by the relevant embassy and should be factored into your timeline.
